Purpose

These General Terms and Conditions (GTC) define the conditions applicable to the services provided by freelance-informatique.org, which specializes in mobile application development, webmastering, information systems engineering, and the provision of professional training adapted to the tools provided.

Scope of Application

Any order for services implies full acceptance of these GTC. No specific conditions may override these GTC without the express, prior, written consent of the service provider.

Services

The service provider offers: Design and development of mobile applications (iOS, Android, hybrid); Creation, redesign, and maintenance of websites (webmastering); Design and implementation of customized information systems; Consulting, technical assistance, and digital project management; Training on the tools provided and customized support. Training on third-party solutions or technologies.

Orders and Quotes

All work requires a detailed quote. The client’s signature of the quote, or written acceptance (including by email), constitutes a purchase order and contractual commitment. The quote includes deliverables, estimated deadlines, financial terms, and any specific conditions.

Prices and Payments

Prices are expressed in euros, excluding tax (excluding VAT), and subject to the applicable VAT. Unless otherwise agreed, payment is made according to the following schedule: 30% deposit upon ordering; 40% during work in progress or upon the defined interim delivery; 30% upon final delivery. Invoices are payable within 30 days of the issue date. Any delay automatically results in: late payment penalties calculated at the current legal rate; a fixed penalty of €40 for recovery costs.

Delivery Times

The deadlines indicated are for informational purposes only. The service provider cannot be held responsible for delays due to a lack of cooperation, late submission of information, requests for unforeseen changes, or force majeure.

Intellectual Property

Unless otherwise specified in the quote or contract, freelance-informatique.org retains full intellectual property rights to the source code, scripts, libraries, frameworks, tools, and documentation produced as part of its services. The client is granted a non-exclusive, non-transferable, and non-assignable right of use, strictly limited to the internal use of the deliverables for the purposes of its business. Any partial or total assignment of rights must be subject to a specific written agreement and will result in a separate invoice.

Support and Maintenance

The service provider may offer a post-delivery technical support contract including, depending on the options selected: Bug fixes; User assistance; Minor technical updates; Availability and performance monitoring. Unless a specific contract is signed, support is not included in the development services and will be billed based on time spent or a fixed price.

Training

The service provider provides technical training tailored to the solutions delivered, in the form of individual or group sessions, in person or remotely. Training is subject to a program and an agreement specifying the educational and financial terms and conditions. In the event of cancellation by the client less than 5 business days before the session, 50% of the amount remains due.

Client Obligations

The client undertakes to: Provide the information and access necessary for the performance of the services in a timely manner; Validate intermediate steps within the agreed deadlines; Pay invoices on the due dates. The client remains solely responsible for the use of the deliverables within its environment.

Liability

The service provider’s liability is limited to the total amount of the service concerned. It cannot be held liable for indirect damages such as loss of data, revenue, or damage to image. In the event of subcontracting, the service provider remains the client’s sole point of contact.

Confidentiality

The parties undertake to keep strictly confidential the documents, data, methods, and know-how exchanged during the collaboration, during and after the end of the contract.

Termination

Any order may be terminated by either party in the event of a serious breach by the other party of its obligations, which has not been remedied within 15 days of formal notice by letter registered mail with acknowledgment of receipt. Services provided remain due.

Complaints and Disputes

All complaints must be submitted in writing within 15 days of delivery. Failing an amicable agreement, disputes will be submitted to the exclusive jurisdiction of the Commercial Court of [Your city], including in the event of multiple defendants or third-party claims.

Acceptance of the General Terms and Conditions

The customer declares to have read and accepted without reservation these General Terms and Conditions of Sale. They are available at any time upon request.
